These Terms of Service (“Terms”) are a legal agreement between you and Bidzeo LLC (“Bidzeo,” “we,” “us,” or “our”) and govern your access to and use of our website, application, and services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who can use Bidzeo
You must be at least 18 years old and able to form a binding contract to use the Service. Bidzeo is currently offered to home buyers in Florida. You agree to provide accurate, current, and complete information and to keep it up to date.
2. What Bidzeo is
Bidzeo is a buyer-first marketplace. You create one verified profile, invited providers compete to present offers, and you choose the offer that fits. Bidzeo is free for buyers; providers pay to participate.
Bidzeo is a marketplace, not a provider. Bidzeo does not provide financing and does not make offers itself. All offers are made by independent third-party providers. Bidzeo does not guarantee that you will receive any offer, that any particular offer will be available, or that any offer will be approved. Any agreement you enter into is solely between you and the provider.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used improperly.
4. Communications consent
By providing your contact information and opting in, you agree to receive communications from Bidzeo, including email and text messages, as described in our Privacy Policy & Messaging Terms. Message and data rates may apply to text messages. You can opt out of text messages at any time by replying STOP, and this will not affect your ability to use the Service.
5. How offers work
Offers presented through the marketplace are provided by independent providers and are subject to each provider’s own terms, verification, and approval process. Offers may be estimates, may change, and are not final until confirmed directly with the provider. You are under no obligation to accept any offer, and choosing a provider is entirely your decision.
6. No professional advice
The Service and its content are provided for general informational purposes only and do not constitute financial, legal, tax, or other professional advice. You should consult your own qualified advisors before making decisions. Any decision you make based on information from the Service is your sole responsibility.
7. Acceptable use
You agree not to:
- Provide false, misleading, or fraudulent information
- Use the Service for any unlawful purpose or in violation of these Terms
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems
- Scrape, copy, or harvest data from the Service without our permission
- Impersonate any person or misrepresent your affiliation with any person or entity
8. Intellectual property
The Service, including its design, text, graphics, logos, and software, is owned by Bidzeo or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works without our prior written consent.
9. Third-party services and links
The Service may reference or link to third-party providers, websites, or services that we do not control. We are not responsible for the content, offers, products, services, or practices of any third party. Your dealings with any third party are solely between you and that third party.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any offers or information will meet your expectations.
11. Limitation of liability
To the fullest extent permitted by law, Bidzeo and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service. To the extent liability cannot be excluded, our total liability for any claim will not exceed one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless Bidzeo and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, unless otherwise required by applicable law.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at our discretion, including if you violate these Terms. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
